Terms of Service

Effective September 30, 2026

These Terms of Service (“Terms”) govern your use of the Emory website and service (the “Service”) provided by Emory Atelier LLC (“Emory”, “we”, “us”). Please read them carefully. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service.

2. Accounts

You are responsible for your account and for all activity under it. Accounts are personal and may not be shared or transferred. Please tell us promptly if you believe your account has been compromised.

3. The Service

Emory provides personalized clothing recommendations featuring products from third-party retailers. Emory is not a retailer. Any purchase you make is between you and the retailer, on the retailer’s terms.

Product information, such as prices and availability, comes from retailers and may be inaccurate or change without notice. Recommendations are suggestions only.

We may change, suspend or discontinue any part of the Service at any time. If you send us feedback, we may use it without obligation to you.

4. Your content

You keep ownership of the content you submit (“Your Content”). You grant Emory a non-exclusive, royalty-free license to use Your Content to operate, provide and improve the Service. You confirm that you have the right to submit Your Content.

5. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose or in violation of these Terms;
  • access or attempt to access accounts, systems or data that are not yours, or interfere with the Service;
  • scrape, copy, resell or reverse engineer the Service, except where the law allows;
  • submit content that is unlawful, harmful, or that you do not have the right to share.

6. Intellectual property

The Service and its content, features and branding are owned by Emory and its licensors. Except for the limited right to use the Service under these Terms, no rights are granted to you. Third-party trademarks and product images belong to their owners.

7. Third-party sites

The Service links to websites we do not control. We are not responsible for their content, products or practices.

8. Fees

We may charge fees for some or all of the Service. Prices and payment terms will be shown to you before you are charged.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ITS RECOMMENDATIONS WILL BE ACCURATE, UNINTERRUPTED OR ERROR-FREE.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EMORY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM PRODUCTS YOU BUY FROM RETAILERS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS. Some jurisdictions do not allow these limitations, so they may not apply to you.

11. Indemnification

You agree to indemnify and hold Emory harmless from claims, losses and expenses, including reasonable legal fees, arising from your use of the Service or your violation of these Terms.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or end your access at any time, including if you violate these Terms. Sections that by their nature should survive termination will survive.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms here with a new effective date and, if the changes are material, notify you before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Kings County, New York, and you consent to their jurisdiction.
